NY HUT Requirements

New York HUT permit requirements.

Understand who needs New York HUT registration, what is required before operating, and the mileage records and tax returns required after registration.

1. Determine whether the vehicle is subject to NY HUT

A regular HUT certificate of registration and decal are generally required before a truck, tractor, or other self-propelled vehicle operates on New York public highways when its gross weight, alone or in combination, is more than 18,000 pounds. Certain vehicles and exclusively exempt uses are excluded, so the vehicle's configuration and actual operation matter.

2. Gather the carrier and vehicle information

To establish or update a HUT account and obtain the correct vehicle credential, have accurate carrier identity and vehicle information ready. Missing or inconsistent information can delay issuance.

  • Legal business name and tax identification information
  • USDOT number and carrier contact details
  • VIN, year, make, and model
  • Plate number and plate jurisdiction
  • Gross and unloaded weights, as applicable
  • Vehicle ownership or lease information

3. Obtain the certificate and affix the decal before operating

Each qualifying vehicle must have its own HUT certificate of registration and decal. The decal is vehicle-specific, cannot be transferred, and must be securely and conspicuously affixed near the vehicle's front license plate. The carrier must keep the certificate of registration at its regular place of business.

4. Keep daily mileage and trip records

After regular registration, the carrier must keep daily records for each registered truck or tractor. Records must support the actual mileage reported and distinguish taxable from nontaxable operation.

  • Certificate number, plate, VIN, and vehicle owner
  • Trip date, origin, and destination
  • New York miles and miles outside New York
  • Toll-paid New York State Thruway miles
  • Laden and unladen New York miles when using the gross-weight method
  • Monthly vehicle summaries and supporting toll, dispatch, fuel, and trip records

5. File Form MT-903 even when no tax is due

A carrier issued a regular HUT or AFC certificate must file every required Highway Use Tax return, even when there was no New York activity, no tax is due, or another person will pay the tax. Returns may be Web Filed or submitted on Form MT-903. A temporary trip certificate does not create this recurring return requirement.

6. Follow the filing schedule assigned to the account

New registrants generally begin as quarterly filers unless the New York Tax Department assigns a different frequency. Quarterly returns are due April 30, July 31, October 31, and January 31. After a full calendar year, the department may change an account to monthly or annual filing based on the prior year's HUT liability.

  • January–March: due April 30
  • April–June: due July 31
  • July–September: due October 31
  • October–December: due January 31 of the following year

7. Retain records and keep vehicle information current

HUT records generally must be retained for at least four years from the return due date or filing date, whichever is later. Report plate changes and increases in gross or unloaded weight so a revised certificate can be issued. A lost or damaged certificate or decal requires a replacement; credentials cannot be moved to another vehicle.

Common questions

Does every commercial truck need NY HUT?

No. A HUT certificate is generally required for a truck, tractor, or other self-propelled vehicle operating on New York public highways with a gross weight, alone or in combination, of more than 18,000 pounds. Excluded and exempt vehicles must be evaluated separately.

What must I do after receiving a regular HUT permit?

Affix the vehicle-specific decal, keep the registration certificate at the regular place of business, track each registered vehicle's daily New York mileage, retain supporting records, and file every return assigned to the account.

Do I have to file if the truck had zero New York miles?

Yes. If you hold a regular HUT or AFC certificate, you must file the required return even when there was no New York activity or no tax is due.

Are NY HUT returns always quarterly?

New accounts generally begin quarterly unless notified otherwise. Filing frequency may later become monthly, quarterly, or annual based on the prior calendar year's HUT liability.

Does a temporary trip certificate require quarterly returns?

No. The recurring HUT return requirement does not apply solely because a carrier obtained a temporary trip certificate for occasional New York operation.

Is Form TMT-1 the quarterly tax return?

No. Form TMT-1 is used to apply for HUT or AFC certificates and decals. The recurring Highway Use Tax return is Form MT-903 or the equivalent HUT Web File submission.
