Do I need to file a NY HUT return with zero mileage?

A common compliance mistake is assuming that no New York mileage means no return is required. An active regular HUT account may still have a filing obligation for the period even when the carrier reports no taxable activity or no tax due.

No activity does not automatically close the filing obligation

Regular HUT registration creates an ongoing tax account. The filing requirement continues until the account status or filing obligation is formally changed by the New York State Department of Taxation and Finance.

A carrier should not simply stop filing because a truck was parked, sold, or did not enter New York during a quarter.

Keep records supporting the zero-mileage report

Maintain records that explain why no taxable New York mileage is being reported.

  • Trip reports and dispatch records
  • Mileage and fuel records
  • Vehicle in-service and out-of-service dates
  • Sale or disposal records when a vehicle leaves the fleet
  • Account correspondence and filing confirmations

Quarterly filing deadlines

Calendar-quarter returns are generally due April 30, July 31, October 31, and January 31 for the preceding quarter. Confirm the current filing requirement and due date with the New York State Department of Taxation and Finance.

File on time even when the return reports zero taxable mileage or no tax due, unless the Department has confirmed that no return is required.

Future NYHUT filing assistance

NYHUT plans to offer quarterly MT-903/HUT return filing assistance, deadline reminders, and filing-history storage through the My NYHUT compliance portal in a future phase. No return is currently filed automatically through the portal.
