A temporary trip certificate serves occasional operation and does not itself create recurring regular-account filing.

Weight and mileage affect calculation

New York provides gross-weight and unloaded-weight methods. The method, classification, weight group, laden status, and taxable mileage affect the calculation.

Keep the daily records that support the weight-distance return

New York requires records that allow each reported return amount to be traced back to the vehicle and its daily operation. The records should separate taxable and nontaxable mileage and be retained for at least four years from the return due date or filing date, whichever is later.

Conditional exemptions depend on actual use

Some HUT exemptions depend on a vehicle being used exclusively for a qualifying exempt purpose. A carrier should not assume that the vehicle remains exempt merely because most of its work qualifies.

When an exempt vehicle is used for a nonexempt purpose during a month, New York requires the carrier to report and pay tax on both the exempt and nonexempt mileage for the entire calendar month in which the nonexempt use occurs. Keep records detailed enough to establish the vehicle's actual use for each reporting period.
